Liberty as founding condition of law
Abstract
This article begins by proposing a systemic vision of Law anchored in Roman roots, creators of an independent organic and conceptual system. On this basis, the idea of freedom is defended as a necessary and founding condition of ethical and legal systems. From here, the existence of a fundamental aporia between a necessary condition, which cannot be defined by its contingent consequences, and the attempts to define and use the notion of freedom in legal systems that turn out to be a consequence of that condition becomes evident.
