Common-law marriage recognized by the Ecuadorian Constitution and its legal consequences.

Abstract

Common-law marriage is a social reality that has existed since ancient times, but it has been legally recognized in Ecuador since the Constitution of 1978. However, this concept has undergone several reforms and modifications over time, from its definition to its legal consequences. The objective of this research is to analyze Article 68 of the current Constitution of the Republic of Ecuador, regarding common-law marriage and the initiation of its legal effects. This analysis will be based on the review of current legislation, jurisprudence, and doctrine.

Diego Alexander Tinoco Yazbek, is a graduate of the National University of Loja, in the career of Law, currently performs the functions of regional secretary of Coactivas of the Ministry of Labor Zonal No. 7 of Loja, El Oro and Zamora Chinchipe; his research work has focused on constitutional and civil matters in Ecuador.
