The right to health, a constitutional pathway

Abstract

Since the end of the dictatorship, and the fourty years of democracy, that with all the troubles, has been the period with the most institutional stability. Heath as a right further than the dichotomy «health. Sickness», has been affirming with respect to citizen rights in regards public responsabilities. This normative our has in the constitutional court a interpreter and a content dispenser that allows to understand this right in ots relationship and complementarity, and its problematic for his demand and application. Between the formal side of the law and its realization throught the decisions made by the constitutional court, this article propose a tour of knowledge and critical thinking.
